Due Process

The Controlled Substance Act is an “administrative code of regulation
(a form of contract law) for registrants within the Federal Agency FDA.  
This includes pharmaceutical corporations who manufacture FDA-approved medicines. 
If you are not a registrant within the Agency can this “code of regulation” apply to you?  

The above facts have been filed as motions in several Federal Courts, by many patients/prisoners.  
The Federal prosecutors have yet to challenge the motions.  
If the Feds have jurisdiction over marijuana  or other substances, why don’t they produce it in court?   

Our judges’ have refused to rule on this issue, thus violating Our right to due process of law.

BILL OF RIGHTS - ARTICLE 5 

No person shall … be deprived of life, liberty, or property, without due process of law….

 
Due Process of law:  to have the right of controverting, by proof, every material fact….  
If any question of fact or liability be conclusively presumed against him, 
this is not due process of law.

Color of law:  the appearance, without the substance, of a legal right.  Blacks Law Dictionary

 

 

Without jurisdiction, armed agents of the DEA continue to arrest patients under color of law. 

 

Without jurisdiction, judges continue to sentence patients to prison under color of law.  At least one patient, convicted under color of law, has died in prison.

 

Shouldn’t We the People hold our government servants accountable for crimes and criminal activities perpetrated under color of law.  If We the People remain silent, are We not then effectively conspiring with the government to violate rights under color of law?

Title 18--Crimes and Criminal Procedure

Statute 242.   Deprivation of rights under color of law

 

         Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State … to the deprivation of any rights, … secured or protected by the Constitution or laws of the United States, … shall be fined under this title or imprisoned not more than one year, or both; and… if such acts include the use, attempted use, or threatened use of a dangerous weapon, … shall be fined … or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping …, shall be fined … or imprisoned for any term of years or for life, or both, or may be sentenced to death.
